In a letter dated December 20 and addressed to Members of the Big Walnut Local Schools Board of Education, the Senior Staff Attorney, the American Civil Liberties Union (ACLU) of Ohio called on the Board to reverse its decision to pass a resolution pertaining to “Flags and Displays.”
In that decision, the Board voted 3-2 to regulate what types of flags and other material may be displayed in district classrooms.
The measure allowed for the display of flags of the United States, Ohio, branches of the military, and those of other states and countries, while saying that banners, signs or symbols that promote activist causes or are otherwise deemed controversial” are prohibited.
The letter from the ACLU of Ohio shares several reasons why it believes the action for the Big Walnut Board violates the US Constitution and case law. Calling the measure vague, it also includes alleged specific comments of Board members which it says demonstrates an intent to disfavor specific categories of free speech. It concludes by asking for a reversal, sharing that it “may be forced to take legal action” if the Board refuses to do so.
